Claim for Accidents at Work - What Evidence do I Need?
When considering ‘what evidence do I need to support my claim for accidents at work?’ the focus should be on images of the accident site, any CCTV of the incident, and other key elements that can prove liability resides with the employer.
Witness statements, your version of events, and a record of the accident being noted in the company’s logbook can all help your claim.
Evidence, understandably, is hugely important in the process – the more you have, the better your chances of success.
Are you eligible to claim for accidents at work?
If you have suffered an injury because of an accident at work, and the cause of it wasn’t your fault, you could be eligible to claim personal injury compensation.
A claim of this nature will depend on liability being accepted by the at-fault party and so evidence will be required to prove this.
I am extremely happy with Winn Solicitors, each and every individual who handled my claim and the final outcome. I would certainly recommend Winns to others who have been involved in an accident which was not their fault.

What evidence would help?
If the accident took place in the workplace, the chances are the setting of the incident will be covered by CCTV. This could be a crucial piece of evidence as it will document exactly how the chain of events unfolded.
Photographs of the accident site should also be taken, if possible. This can highlight any trip hazards, or unsafe stacking of objects if applicable to your claim.
Witness statements that corroborate your version of events would also help. If someone was in the vicinity when the accident occurred, and saw what happened, ask them to write a statement describing the accident and what they believe caused it. Even just getting their contact details would be useful, as your claim handler can follow up with them to get an account from their perspective.

Is there a time limit on gathering evidence?
It is advisable to gather as much evidence as close to the time of the accident as possible, so important details aren’t missed by those involved and CCTV footage, if available, can be utilised before any deletion takes place as part of a company policy.
Witness statements will also be more detailed as the incident is still at the forefront of the mind.
