Warehouse Accident Claim with Winns

Heavy loads, bustling workplaces, and a potentially hazardous environment. It is perhaps no surprise that a warehouse accident claim is more common than you might think.

Particularly considering the movement of heavy goods, usually with large-scale machinery in close proximity to workers on foot, there are plenty of accidents waiting to happen, especially in a setting where workers may be working at a hectic pace.

When an accident does occur, and it wasn’t your fault, you could be eligible for a compensation claim.

What type of accidents are most common in a warehouse accident claim?

In a warehouse setting, more often than not there are towering stacks of shelving with products that can be heavy and packed in bulk. There will be raised positions for workers to navigate, as well as plenty of objects on the floor that may be ignored or forgotten about during the working day.

With multiple forklift trucks possibly in operation, particularly in bigger warehouses, the types of industrial accidents can include:

  • A fall from height – If workers are expected to work from a raised position, the danger of falling is obvious; the need for stringent health and safety practices is of paramount importance.
  • Slip at work – Warehouses are traditionally busy environments with staff going about their day carrying out multiple tasks. If something is left accidentally on the floor, or a spillage goes unnoticed, there can be an increased chance of a slip at work which, if on a hard surface, can lead to serious injury.
  • Forklift truck – The close proximity of forklifts being operated and workers on foot, in a busy area, can lead to serious incidents and injuries being sustained.
  • Defective equipment – Although equipment should be tested regularly, inevitably issues may arise through natural wear and tear and repeated use over time. When the equipment becomes defective, courtesy of frayed wiring or faulty internal elements, the possibility of an injury as a result is increased.

The accident only happened this afternoon but the response from the solicitor has been swift, comprehensive, and reassuring.

FAQs

What will happen when I make a claim?

The process of making a claim starts with an initial discussion of your circumstances with one of the team at Winns. Once established that the incident is eligible, the gathering of evidence and relevant information begins. The more evidence attached to the claim the better as it provides a stronger argument as to who is liable.

How long do I have to make a claim?

There are exceptions in terms of how long you have to start a claim after the accident. But in most circumstances, there is a three-year statutory limit, as dictated by law, from the date of the accident. The claim doesn’t need to finish in this timeframe, but it does need to be submitted before the end of the three-year period.

What can compensation pay for?

Compensation makes a tangible difference to those affected by injury as it can help with treatment and recovery from injuries.

The funds received if successful can go towards private treatment, physio, psychological therapy, house alterations to accommodate a change in your physical condition, loss of earnings, and different out-of-pocket expenses (like travel costs for hospital appointments for example).

The amount of compensation received depends on the severity of the injuries sustained and the impact they will have on your day-to-day life. If you need payments before the end of the claim, we can negotiate interim payments with the third-party insurer which can be used for ongoing care costs and expenses before the conclusion of the claim.
