Scarring Compensation: Can You Make a Claim?

Are you looking for information and guidance following an accident that wasn’t your fault which left you with scarring? Need an expert advisor to explain the process of making a scarring compensation claim? Talk to Winns and receive a helping hand.

Can you make a claim?

Making a claim for personal injury compensation is straightforward to set up, especially with Winns managing your case from start to finish.

If you have suffered scarring as a result of an accident that wasn’t your fault, and you are 18 or older (or have given permission to a legal guardian to conduct the claim on your behalf if you’re under 18) then you may be entitled to make a claim for scarring compensation.

The time limit for making a claim is within three years of the accident taking place, however, there are exceptions, and these can be discussed with you when you contact our team.

How do I make a scarring compensation claim?

Anyone who has suffered an injury following a non-fault accident can easily make a compensation claim. Working with Winns takes away the stress and hassle associated with contacting multiple different agencies and organising a potentially complicated, multi-faceted claim. The first step to making a claim? Contact Winns and begin the process today. We’ll take care of the rest.

Who do I make the claim against?

You are making a claim against the at-fault party involved in your accident. So, in the case of a car accident, it is the driver who caused the accident who is liable.

If your accident took place in a workplace or public place then it will be the organisation who owns or has based their business in that building or space who will be liable.

Once liability is established and accepted, the at-fault party should then have an insurance provider – a driver must have car insurance, while organisations will usually have public liability and/or employers liability cover - acting on their behalf with regards to payment of compensation.

What are the most common scarring injury scenarios?

No scarring injury scenario is the same, as circumstances and consequences often vary. However, there are general groupings:

  • Chemical exposure
  • Tattoo, cosmetic, hairdressing injuries
  • Cuts or lacerations
  • Burns and scalds

There is a range of information available from the NHS in relation to scarring, its impacts and possible treatments. Click here to find out more.

Winns has helped many people who have sought scarring compensation, including in the case of one client, who worked in a chip shop. After the claimant had dropped one of the blocks of beef dripping into a boiling pan – the block was a different shape to usual and they hadn’t received the appropriate training - it fell towards them and caused fat to splash into the claimant’s face. They suffered hot fat scalding to the right side of the face and neck, consisting of superficial and partial thickness burns.

They contacted Winns and, despite the third-party contesting liability throughout, the claimant was awarded personal injury compensation.

“I was pleased to have Winns on my side as I didn’t know where to start,” they said. “There were times when I thought about just leaving it, but they really helped.”

Scarring compensation claim FAQ section

Can you sue for a scar?

If the scar is as a result of a non-fault accident then you are entitled to make a claim for personal injury compensation.

As long as liability is accepted by the third party, then you will be eligible for compensation; how much depends entirely on the severity of the injury and circumstances of the accident.

Contact Winns and a member of the team will ask the relevant questions to provide greater clarity and guidance on your claim.

How much facial scar compensation can I claim for?

The amount of compensation potentially available for a facial scar personal injury claim is based on the severity of the injury and the complexity and duration of the recovery process. The circumstances of the accident are also a hugely relevant point in this calculation; discussing it with a Winns representative will allow you to gain a clearer picture.

If you wish to find out more about the types of facial injuries we deal with, click here to be taken to our facial injury page. Alternatively, click here to find out about the range of injuries we can support clients with in respect of a personal injury claim.

Can you claim for other expenses as part of a claim following an accident?

There are many different elements to a claim, with additional expenses which can be recovered from the other side.

The exact amounts and types of compensation are dependent on your circumstances, but scenarios like taking the bus/taxi for appointments, because your car was damaged in the accident or you are unable to drive as a result of your accident, means you could claim back the costs associated.
