Selling Home Proves Problematic in Probate Stand-off
When a loved one passes away, the last thing that should be causing you concern is the settling of their financial matters.
Sometimes, with the best intentions, people think they have dealt with the entire estate and forget about the property. There are some occasions when a grant is not needed for a property sale, for example when the property is held as joint tenants and it is passing to the survivor.
However, sometimes a discovery is made years later that the Probate is needed and if this is discovered in the middle of a house sale transaction it can be compromising to the sale. Obtaining probate some years later can be more complex as the Will may be somewhere unexpected, not available, even lost or whereabouts unknown. Establishing the values of the estate after several years have passed can also be complex.
