The scenario

Anita and Bill got married and had a son earlier in life. Unfortunately, when living together as a family, they became estranged from their son as he had stolen money from them. This took place 30 years ago.

More recently they developed a very close relationship with a niece and wanted to give her everything when they passed away as they no longer had contact with their son.

They had no Will or Lasting Power of Attorney and kept putting off the process of getting them.

What went wrong?

Anita developed dementia, with her health deteriorating to a point where she could no longer make a Will or LPA, and Bill died suddenly, leaving his estate, to his wife.

But because Anita didn’t have a Will, under the rules of Intestacy everything should go to the estranged son.

To make matters worse, the son came back into Anita’s life and applied for the Deputy application to manage her financial affairs. Despite the niece having looked after Anita and Bill for decades there was now an application for the estranged son to be involved.  Would they want the son in charge of their financial decisions?
