Winns Secures Substantial Payout for Woman with Life-Altering Injuries
A woman who suffered severe and life-altering injuries as the result of a collision with a bus has received a considerable settlement, thanks to Winn Solicitors.
The woman, who was 23 at the time of the accident but cannot be named for legal reasons, was awarded £3m after being struck by the bus in the middle of Newcastle's busy city centre when crossing the road. The accident left her with extremely serious injuries, including severe head trauma, intra-ventricular haemorrhaging, and a worsening of pre-existing cerebellar ataxia.
An intra-cranial bolt was inserted before the claimant was eventually moved to Walkergate Park Hospital for the start of her rehabilitation. Rehabilitation continued after she was discharged, although she is still at a great risk of post-traumatic epilepsy, suffers with double vision, and has ongoing problems with cognitive function.
The bus company, a public transport provider that is well-known in the region, denied liability, and Winn Solicitors was appointed to the case. David Burn from the Winn Solicitors Serious Injuries Team, a solicitor specialising in head injuries, represented the claimant in order to provide expert advice and legal guidance.
Expert Evidence
Expert evidence was brought in in an effort to prove the bus driver was in fact to blame for the collision. This included a 3D laser scanning reconstruction of the scene and the vehicle's trajectory, a highly specialist crash investigation technique that very few specialists in the country can provide. During the course of proceedings, the driver admitted to have been driving slightly over the acceptable speed limit, and in fact had narrowly avoided another incident earlier in the day.
Thanks to the evidence presented and the hard work of Winn Solicitors, a joint settlement was reached. As the claimant is a protected party, i.e. extremely vulnerable and lacking capacity, the final settlement fee of £3m was finalised with court approval.
Moving On
Although she and her family are still learning to cope with the ongoing affects of her injuries, the claimant's life is already being greatly improved by the settlement that Winns helped to broker. The money has been put into buying a new family home, with an independent living space that is both private and equipped with all the necessary adjustments and mobility aids to help her live comfortably.
