Who Is Liable For Accidents On Public Transport?

Millions of us rely on public transport to get us to where we need to go. Whether it's the daily commute or any of the myriad necessary journeys that we make each and every day, we rely on buses, trains, and trams to keep us safe while we travel. And if we are injured during one of those journeys? Well, most people will just shrug it off. Accidents happen.

The fact is though, accountability does lie with the transport operator in a large number of scenarios. If you've had an accident on public transport, ask yourself whether you would make a claim had it happened in another place?

What Public Transport Accidents Can I Claim For?

Put simply, if you have suffered from an accident on public transport, an accident that was not your fault, then you could be eligible to make a claim.

If, for example, a spillage has not been cleaned up on a train, causing you to slip and injure yourself, then you have the same right to claim as if it had happened in a local authority building or office.

Another common injury which occurs on public transport is whiplash. As with travelling by car, whiplash is a strain on the neck caused by sudden braking or stopping, but it's not the only injury that you can sustain in these circumstances. You could fall off your seat, hurt yourself on a safety bar, or even be hit by falling luggage. In more transport-specific cases, you may become trapped in a closing door, or between a vehicle and the platform for example.

In all of these events, it is possible to make a public injury claim.

What Public Transport Accidents Can I Not Claim For?

If the accident that caused your injuries was not the fault of the transport operator, then, unfortunately, you will not be able to make a claim.

If, for example, you have not followed the relevant safety procedures (such as securing luggage, or staying within a relevant area), ignored instructions from staff, or otherwise been partly or fully to blame for your injuries, then it will be difficult to make a case.

If you have any questions or require more information, then the claim handling team at Winns will be able to give you a better idea of whether the injuries you have sustained on public transport can form the basis of a claim.
