Claimant Awarded £620,000 Following Road Traffic Accident

The passenger involved in a road traffic accident has been awarded £620,000 after suffering multiple injuries, which led to invasive and extensive treatment.

What happened?

The claimant was the front seat passenger when the driver negligently lost control of the car, causing it to leave the carriageway, travel down an embankment and hit a tree. The claimant suffered the following injuries:

  • Subdural haematoma which required a craniotomy
  • Associated severe brain injury with ongoing cognitive deficit including reduced memory concentration, processing speed, multi-tasking and fatigue
  • Epilepsy requiring anticonvulsant medication
  • Fractured left clavicle
  • Fractured left index and middle fingers
  • Left pneumothorax with associated pulmonary contusion
  • Anxiety and depression

What happened next?

The claimant then spent a significant amount of time in hospital as their injuries were assessed and his path to recovery plotted. “I was in hospital for four to five weeks and was in an induced coma during that time,” said the claimant of the initial time following the accident.

“When I woke up, it was a very gradual thing and there’s a lot of things I don’t remember. It wasn’t for a long time I thought about my injuries. I didn’t know how much it would affect me later down the line.”

After their initial solicitors failed to progress the claim past the halfway point, Winn Solicitors and their Serious Injury Specialists team were recommended.

“(The initial solicitors) said they wouldn’t be dealing with my type of case anymore so I had to swap solicitors,” the claimant continued when discussing the transfer to Winn Solicitors, who are happy to take over cases where people feel as though they are not receiving the care and expertise required.

“Winns was recommended to me and that was when David (Burn, solicitor) was introduced. At my old solicitors it felt like it was progressing really slowly and the communication wasn’t great. When David started helping, the whole thing felt much better. He was very productive, nothing was ever too much trouble, nothing was ever a hassle and it felt like he was doing a lot to get things moving. I’m really pleased that Winns got involved in my case. It got so much better when they got involved.”

Solicitor David Burn said; “The client was involved in a truly horrific accident. They had to undergo a lifesaving operation in the form of a craniotomy due to the severe brain injury sustained. However, with the implementation of a privately funded care and support package, the client has made great progress and gained a significant degree of independence. I wish the client all the best for the future.”
