Claimant Awarded £265k Following Accident

Winn Solicitors successfully earned an award of £265,000 for a client involved in a road traffic accident.

What happened?

In the summer of 2017, amid awful weather conditions, the claimant pulled into a lay-by to assist a vehicle which had been involved in a car accident. Parked behind another car which had also stopped to help out, the client began walking along the grass verge, only to be hit by the parked vehicle which had been struck by the defendant’s car.

How did it affect the claimant?

As a result of the accident, our client sustained multiple injuries, including to their shoulder, ribs, chest and legs. Speaking about the accident, the claimant remembered little about the actual collision but knew they were facing serious problems after the event.

“It was on the way home and the weather was awful,” said the claimant. “Someone in front had crashed and I pulled over to help. But someone came off the road after that and hit a parked car, which hit me. The next thing I knew I was staring up at the sky wondering what had happened. I was resuscitated a couple of times, but I came round in the hospital and I was going from week to week after that to be honest.”

How did Winn Solicitors help?

The claimant was then faced with a lengthy period of recuperation and rehabilitation as they sought to overcome their injuries.

“I had regular operations and I was really focusing on my injuries rather than too far ahead and how it would affect my life in general,” said the claimant. “Whenever the doctors would come to my bed each day, I wasn’t sure what they were going to say and what they were going to do. The following year, after the accident, was going to be our 25th wedding anniversary and we had planned to go to Canada to see the Formula One Grand Prix. But I wasn’t in a fit state to go.

“I was laid in bed and the talk in the ward was about claims. People kept saying about making a claim. I said to my wife to ring someone; we heard about Winns on the radio and TV. They put us in touch with David Burn and he came to visit for an hour in the hospital. He was quite honest; he talked about the stages we’d go through, what we would need and he was very realistic about things. He also came to see me at home.

“If I needed to ring and he wasn’t available, he’d text or ring back the same day. Whenever I needed information, he was there. I’m very happy I ended up with Winns.”

Burn, his solicitor, was delighted to have helped at a difficult time for the claimant.

“The client had suffered extensive injuries which were through no fault of their own after being hit by a vehicle when trying to help someone else,” he said. “After meeting with him, we were able to get the process moving and allow the client to focus on recovering from their injuries. We were able to gain the client a significant amount of money and help to get their life back following a challenging time.”
