Who can make a claim?

You can begin a personal injury claim if you have been involved in an accident that wasn’t your fault within the last three years. The accident may have taken place in a road traffic accident, at work, in a public place or on commercial premises; we can help you get your life back on track.

Who do I make the claim against?

When making a claim for compensation, your claim is made against the person who was at fault for the accident. Typically, their insurance company would provide them with indemnity and would deal with the claim on their behalf, with the insurer being liable to pay the costs of your claim.

If your accident took place in the workplace or commercial premises, the business in question should have the appropriate insurance(s) in place, which they would use to cover costs as above.

How can a back injury occur?

Unfortunately, there are times when accidents can cause lasting damage or the need for a long-lasting recovery process. Through no fault of your own, this can be sprung upon you, but where are back injuries most likely to happen?

  • Manual handling – When at work, you may be asked to lift an object too heavy for one person. This, without proper manual handling training or the correct equipment to help you lift, can lead to a debilitating back injury which your company would be liable for. Don’t be concerned about claiming against your own employer; they, by law, should have liability insurance so any claim won’t affect them financially. Also, there are stipulations which mean they wouldn’t be able to sack you as a result of making a back injury at work claim.
  • Fall from height – If you are in a workplace and you fall from a height, your accident could be the fault of many things; there may not be the proper provisions in place, the correct equipment may not have been available to you for the task or the essential health and safety measures for people working at a height may not have been thought through and acted upon.

Regardless, if you slip or trip as a result of the surface you are walking on, the organisation responsible for that walkway may be liable for the injuries caused as a result.   • Being struck by a falling object – These accidents can happen due to improperly stacked objects, poorly maintained safety netting or faulty machinery causing pieces to come off, amongst other scenarios.
  • Accident on the road – A road traffic accident can cause any number of injuries to those involved. Back injuries are certainly on that list as the scale of the forces involved in a collision can create a large impact on your body. How much compensation will I get for a back injury?

As with all personal injury compensation claims, the amount you receive will depend on a variety of factors, including the severity of the injury sustained and the impact it will have on your life in the short, medium and long-term.

Compensation available can be up to £134,000 for a back injury, but this is wholly dependent on circumstances and injury severity.

Are there exceptions to the three-year time limit for making a claim?

There are limited exceptions to the three-year time limit when considering making a personal injury claim. Normally you have three years from the date of the accident to submit a claim but there are a few exceptions.

One involves the accident involving a person under the age of 18. Their three-year time limit starts from their 18th birthday.

Another exception would be for those who are being treated under the Mental Health Act, and similarly those who are lacking mental capacity, or are not considered to be sound of mind due to the accident. In these cases, the three-year limitation period would be extended until they have regained their mental capacity or recovered from their mental health issues.

If you are making a claim on behalf of someone who has died, you have three years from the date of their death, unless the three-year limit has passed during the deceased’s lifetime.

The other exception is dependent on the ‘date of knowledge’, or the date on which you realised that you had suffered an injury as the result of an accident, for example, if you did not immediately realise the extent of your injuries, or if they did not manifest themselves until a later date. In this case, the three-year time limit would begin from the ‘date of knowledge’ rather than the accident date.

What are interim compensation payments?

Interim compensation payments may be available if you need additional funds to help with your recovery or require adaptations due to an accident that wasn’t your fault, for example if you need to modify parts of your home as a result of your injury. These can be arranged voluntarily with the at-fault party’s insurance company or by order of the court, as long as the request is not larger than the value of the claim itself.

What if my opponent doesn’t accept responsibility?

If the third-party refuses to accept liability, then you need a team of experts who are experienced in recovering costs. Refusing liability is not the end of any compensation claim.
