Can you make a hip injury compensation claim?

If you are considering making a personal injury claim but aren’t sure if you are eligible, the following list will help provide clarity:

  • Were you involved in a non-fault accident which resulted in injury? If the answer is yes then you may be able to pursue compensation from the at-fault party.
  • Are you 18 or older? You need to be 18 or above to make a claim. If you are under that age, then you need to wait until your 18th birthday or allow a parent to make the claim on your behalf.
  • When was the accident? If the accident was within the last three years then you are within the statutory limits. There is an exception to this rule as someone involved in an accident when under 18 has three years from their 18th birthday to submit a claim before it is ruled out for being ‘time-barred’ by law.

If you fit all of the criteria above then you are eligible to make a claim for personal injury compensation and contribution towards medical costs, as well as any vehicle repair and hire car usage costs should the accident have taken place on the road.

How to make a claim?

The process itself can seem difficult to comprehend. Instructing our specialist team takes all of that pressure away and allows you to progress a claim for hip injury compensation with expert advisors on your side.

All you need to do to start the claim is to contact us on our 24-hour claim line and discuss all aspects of your potential claim with an advisor who will listen, empathise and answer any questions you may have. Alternatively, you can request a call back at a time to suit you or chat with one of our advisors through Live Chat (7am - 7pm every day) on our website.

Who can make a claim?

You can make a claim if you are over the age of 18 and have suffered an injury in a non-fault accident that took place within the last three years. There are certain exceptions, but we’d advise discussing with one of our advisors who can provide the answers to your questions.

Who do I make the claim against?

Depending on the type of accident, you are primarily making the claim against the third-party who was at fault.

They, regardless of being an individual in a vehicle or a business owner, should have appropriate insurance cover for their circumstances:

  • Accident on the road – motor insurance
  • Accident on company premises – employers’ liability and/or public liability insurance
  • Accident in a public place – public liability insurance
  • Accident in rented accommodation – the landlord should have appropriate landlord liability insurance

This insurance provider will deal with the claim, providing indemnity for the third party. If liability is accepted, the insurance provider will be expected to pay the costs which have been assigned to their client at the conclusion of the claim against them.

How can hip injuries occur?

There are many types of hip injuries, which can be hereditary, caused by a heavy blow to the area or developed from birth:

  • Breaks, fractures and dislocations: One of these can develop instantly at the point of contact, as the result of a heavy blow to the hip. Breaks, fractures and dislocations can be more serious in nature, possibly resulting in the need for a hip replacement, which can require extensive recovery and rehabilitation over an extended period of time.
  • Fractured pelvis: Caused by a blow to the pelvis, which can be because of a fall or road traffic accident, a fracture can result in pain in the area for a short amount of time, if minor, or a much more severe situation should there be several breaks.
  • Bursitis: This is caused by inflammation of the bursa, which are positioned between bones and soft tissues (acting as a cushion to reduce friction). An impact in this area can cause the jelly-like sacs to become inflamed.
  • Hip dysplasia: This condition is commonly developed from birth, where the hip socket doesn’t fully cover the ball portion of the upper thighbone. This allows for partial or complete dislocation.
  • Osteoarthritis from hip injuries: This is a condition whereby the protective cartilage on the ends of bones breaks down, causing pain, swelling and problems with movement. It can be caused by a number of factors; overusing joints before full recovery following an injury or operation, as a result of another joint injury, ageing joints, obesity, or it may run in the family.

A hip injury can be debilitating and painful, resulting in time off work and the need for medical treatment. Winns can arrange appropriate medical care and expert legal advice when progressing a claim for personal injury compensation, including a claim for loss of earnings and repairing your vehicle should it be damaged.

Hip injury compensation claim FAQs

Can a car accident cause a hip labral tear or hip bursitis?

A car accident can cause any number of injuries, with hip problems a distinct possibility. Issues such as a hip labral tear or hip bursitis can develop following an accident, with the former possibly making you more likely to develop osteoarthritis in that joint in the future. In respect of the latter, this can cause inflammation following a blow to the hip area, something that is highly possible during a car accident.

How much compensation can you expect from a hip injury?

The amount you may receive following a hip injury compensation claim is dependent largely on the circumstances of your accident and the severity of the injury sustained.

It is important to speak to a specialist about this; by contacting Winns, you can talk to that expert voice, who will be able to assess the merits of your claim quickly and answer any questions you may have.
