Can I be sacked for making an accident at work claim?

The short answer to this is no, you can’t be sacked for claiming against your employer after a non-fault accident. You are protected by UK employment law in that respect providing you with reassurance.

If you feel you have been sacked because of your decision, then you have a right to make a legal claim for unfair dismissal.

I had an accident at work that was not my fault and decided to contact Winn Solicitors to enquire about compensation. My case was not by any means straightforward or easy to work out, it was a rather complicated matter… Winns were there the entire time I had any questions, they were in touch with me immediately if there were any additional details needed, and they [were] very helpful when I did not understand something. I was required to attend 3 medical appointments which Winns kindly took the time to arrange with my needs in mind. Over a long battle between myself, Winns and my previous employer I was notified that my case had been settled in my favour. Overall, I am extremely happy with Winn Solicitors, each and every individual who handled my claim and the final outcome. I would certainly recommend Winns to others who have been involved in an accident which was not their fault.

What should I do if I’m considering making an accident at work claim in the North East?

In the days after the accident, it is important, depending on the circumstances and your availability to do so, to ensure that your company log the accident in their accident log book, which is an essential part of any health and safety compliant work environment.

If they don’t, make a log yourself by noting down the date and relevant details of the accident including what you were doing at the time, how the incident unfolded and what the workspace environment was like at the time of the accident.

Your first priority will be to seek relevant medical treatment to ensure the best possible chance of recovery from your injuries, but it is also crucial to generate a written record of treatment received post-accident.

This record will be useful if you haven’t turned to Winns straight away but are still looking to make a claim with us later down the line. It is important to note that you have three years from the date of the accident to submit a claim for compensation.

Thank you for your help in obtaining due compensation for an accident at work in such a professional manner; I would not hesitate to use the services again or recommend to friends and acquaintances.

Do I get paid if I have an accident at work?

Depending on the terms of your contract agreed with your employer, you will get paid a certain amount. Some companies offer an occupational sickness scheme, and reference to this will be made in the terms of your contract.

If this isn’t available then Statutory Sick Pay is an option; you will receive £94.25 per week before tax for up to 28 weeks, if you have been unable to work for at least four days in a row.

There is more information available on accidents at work through the Citizens Advice page.

I have had an accident at work, what are my rights?

It is the legal obligation of your employer to ensure the work environment is health and safety compliant, and safe to use for employees. They must ensure you are kept safe and provide appropriate training and equipment.

If this doesn’t happen then you have the right to:

  • Make a claim
  • Be compensated for your injuries and employer’s negligence
  • Pursue a claim without being treated detrimentally by your employer
  • Sick pay

If you have any questions about these bullet points following a non-fault accident at work then please don’t hesitate to call Winns.

FAQ

Can I claim for an accident at work?

As long as you weren't at fault for the accident, and it took place at your workplace, causing injury to you, then you will more than likely be eligible to make a claim for personal injury compensation. Call us today for a free, no-obligation chat.

Should I get full pay if injured at work?

There are a few options in this instance. If you've been injured at work, your contract will indicate if your employer has an occupational sickness programme. If not, you will be entitled to Statutory Sick Pay.

How long does an accident at work claim take?

The duration of a claim is based entirely on the circumstances of the accident, the complexity of the claim, and the injuries sustained. If any injury requires lengthy treatment then the case will take longer than those with short-term injuries. There is also the at-fault party to consider and whether they accept liability quickly or deny it repeatedly. Rest assured, our team will work diligently and effectively to achieve a successful outcome for you.

Who is responsible for an accident at work?

If you weren't at fault for the accident, the liability will rest with the employer in most instances. This is the organisation that owns or runs the site where you sustained the injuries. If they're running the site, they have a duty of care to their employees that involves mitigating potential risks.
