How does ‘no win no fee’ work?

The firm you have instructed will assess your claim at the initial point of contact and decide whether to progress it, based on the probability of success. They will then progress the claim, gather the evidence, with your help, and organise all aspects of the case.

Should the outcome be successful, only then will the firm claim their success fee from the personal injury compensation awarded. You will pay nothing towards costs before that point.

If the claim is unsuccessful – and the appropriate legal insurance has been taken out – then you won’t pay for the service.

What percentage do no win no fee solicitors take?

Personal injury solicitors working within the terms of a conditional fee agreement, or no win no fee as it is more commonly known, receive a deduction from the personal injury compensation awarded to a client as payment for the services conducted throughout the claims process. At Winns we take 25% inclusive of VAT. This is a standard fee which most solicitors charge in this situation.

If you have a legal expenses insurance policy (as part of your motor insurance), and you make a claim with Winns, then you may not be subject to our success fee as we can often match the terms of your policy.

What happens if I lose my no win no fee claim?

If your claim is unsuccessful, provided you were honest and have fully cooperated throughout your claim, you will not be asked to cover any legal costs associated with your claim.

How long after an accident can you claim in the UK?

For the majority of circumstances, you have a three-year limit, as set by law, to submit your claim. This starts from the date of your accident and once that time runs out, you cannot then put a claim in relating to said accident.

There are certain exemptions, including reduced mental capacity or being under the age of 18 (your three-year limit starts from your 18th birthday), or in the case of a deceased loved one (the time limit begins from the day it is discovered what caused them to pass away).
