

What Should I Do if I'm in an Accident with an Uninsured Driver?

With around 1.2 million uninsured drivers on the roads – that’s about one in 36, the odds of being involved in an accident with an uninsured driver are not as low as you may think. Every year, there are around 25,000 incidents from uninsured drivers, across the UK.

If the other driver is uninsured, the process for claiming compensation is different. Your claim will be made through the Motor Insurance Bureau (MIB), under the ‘uninsured driver’s agreement’. The MIB was set up in 1946 as a means of compensating victims of accidents caused by drivers who weren’t insured, or who can’t be found. It is funded by motor insurance policy premiums – approximately £15 - £30 of every insured driver’s premium goes towards this fund. As well as claiming compensation for your accident, you may also be entitled to claim for things such as loss of earnings, medical and personal care costs, and adaptations to your home, in the case of a serious accident.
In order to make a claim through the Motor Insurance Bureau, you should notify your insurer of the claim, first of all. You should also report the accident to the police, if it was a hit and run driver. In this case, you would need to give as many details as possible to the police. You can then make your claim online through the MIB.
What should I do at the scene of an accident with an uninsured driver?
At the scene of the accident, you should take down as much information as you can, much like you would at any other type of accident. Key details that you should remember to obtain include:
• Contact details of the driver
• Car make, model and registration
• How the accident happened and do a detailed drawing of what occurred
• As many photos as possible
